Progress on the Sprint-Clearwire WiMAX JV can go forward, for now, without trouble from affiliate iPCS Inc.
On Monday an Illinois circuit court said that iPCS must withdraw its motion for a temporary restraining order on the deal.

| I dont think the Chicago market would have anything to do with it since they were never an IPCS market. |

Chicago and the surrounding area in that part of Illinois and Indiana is not in the ipcs inc. market according to the territory map posted on the ipcswirelessinc.com site. I think had the court decision gone against Sprint - Clearwire the roll out time line could have been influenced.

I know IPCS very well.. I lived in Decatur IL and Fort Wayne IN for a few years and I was in Bloomington IL when they first launched in 1999. Things look VERY bright for XOHM/Clearwire now... They were gobbled up first by Airgate PCS.. |

| Clearwire has said that the earliest WiMAX will be made available in any of the iPCS-covered territories will be July of 2009, but it isn't clear just yet WHICH markets they plan to launch first. They've got a pretty big footprint so anyone's guess is as good as mine, but I would assume that the key markets (Scranton, etc) will be the first in line. |

| I hope it isn't Scranton PA.. Scranton/Wilke-Barre is in the top 10 biggest economic decliners this year... Now I can see Fort Wayne happening.. |
